Article 1 (Scope)
These Terms of Service govern the use of PhotoCal provided by Akihiro Tamura ("Operator"). By using this service, you agree to these terms.
Article 2 (Definitions)
- "User" means any person who uses this service.
- "Content" means templates, calendar images, text, and any related information.
- "Template Image" means image materials included in templates on this service, including photos taken by the operator, royalty-free materials, and AI-filtered images.
Article 3 (Account)
Some features require account registration. Users must keep their registration information accurate and up to date and are responsible for account management. Transfer or lending of accounts is prohibited.
Article 4 (Template Image Usage)
Template images are based on original photos (such as Japanese landscapes, shrines, valleys, and night views) and some royalty-free materials. Many images are processed with AI filters in an animation-like style, while some are not processed.
- Personal use (creating, printing, gifting calendars) is allowed.
- Calendar images created with this service may be used for personal and commercial purposes.
- Redistribution or resale of template images themselves is prohibited.
- Using template images as standalone assets or in asset packs is prohibited.
Article 5 (User Uploaded Photos)
Copyright of user-uploaded photos belongs to the user. Users guarantee they have the necessary rights and permissions. The operator does not use uploaded photos beyond service provision.
Article 6 (Prohibited Conduct)
- Violation of laws or public order and morals
- Criminal or unlawful acts
- Unauthorized access or excessive load on servers
- Infringement of third-party intellectual property, portrait, or privacy rights
- Acts that interfere with service operation
- Acts violating Article 4 image usage conditions
Article 7 (Paid Services / Refunds)
Due to the nature of digital content, refunds are generally not available after purchase. However, significant defects may be handled on a case-by-case basis.
Article 8 (Disclaimer)
Except in cases of willful misconduct or gross negligence by the operator, the operator is not liable for damages arising from this service. The service is provided as is without warranty.
Article 9 (Change / Suspension)
The operator may change or suspend this service without prior notice and is not liable for resulting damages.
Article 10 (Amendments)
These terms may be updated as necessary. Updated terms take effect when posted on this page.
Article 11 (Governing Law / Jurisdiction)
These terms are governed by Japanese law. The court having jurisdiction over the operator's address shall have exclusive jurisdiction in the first instance.
